Pupil Privacy Notice
This notice explains what personal information Xpert Driver Training Ltd collects about pupils and their parents or guardians, why we use it, who we share it with, how long we keep it, and your rights. It applies to everyone who takes driving lessons with an Xpert Driver Training instructor.
1. Who we are

2. What we collect
- Identity and contact details: name, address, phone number, email address, date of birth, and a parent or guardian's details for pupils under 18.
- Driving licence details: your licence details and the result of your licence check.
- Health and learning needs: only what you choose to tell us, so your lessons can be adapted.
- Lessons and progress: bookings, lesson notes, progress, and test dates and results.
- Payments: amounts paid, lessons paid for in advance, and refunds. We do not store card details.
- Messages: texts, emails and app messages about your lessons.
- Dashcam footage: recorded during lessons.
- Photos and videos: only with your written consent.
3. Why we use it, and our legal basis
- Booking and delivering your lessons, and taking payment: contract.
- Checking you are entitled to drive, keeping tax and business records, and meeting DVSA requirements: legal obligation.
- Dashcam, safety and handling complaints: legitimate interests.
- Health or learning needs you tell us about: your explicit consent.
- Pass photos and videos on social media: your consent, which you can withdraw at any time.
- Safeguarding referrals: legal obligation and substantial public interest.
4. Who we share it with
- Your instructor, who is a self-employed instructor working under the Xpert Driver Training franchise.
- Total Drive, our booking system, and learning tools such as Theory Test Pro, which store information for us.
- DVSA, where the law or the Driving Instructor Code of Practice requires it.
- The police, local authority or other agencies, where needed to keep someone safe or to prevent crime.
- Insurers and professional advisers, if there is an incident, claim or legal matter.
We never sell your information. Some of our suppliers may store data outside the UK. Where they do, the safeguards required by UK data protection law are in place.
5. How long we keep it
- Lesson and payment records: 6 years after your last lesson.
- Dashcam footage: overwritten automatically within 7 days, unless it is saved because it is needed for an incident, complaint or safety matter.
- Photo and video consent records: while the post is live, and for 12 months after it is removed.
- Complaint records: 6 years after the complaint is closed.
- Safeguarding records: as long as the law or statutory guidance requires.
6. Your rights
You have the right to ask for a copy of your information, to have it corrected, deleted or restricted, to object to how it is used, to have it transferred, and to withdraw your consent at any time. To use any of these rights, contact us using the details above. We will respond within one month.
7. Pupils under 18
Pupils aged 13 and over can make their own requests about their information. We may also talk to a parent or guardian about lessons, bookings and payments where they arranged or pay for them.
8. Complaints
If you are unhappy with how we have used your information, please contact us first so we can try to put it right. You can also complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
